Carey Rodriguez Featured in New York Daily News on 'Santa' Song Rights

The New York Daily News is reporting on a major copyright victory for the family of the original songwriter of the holiday hit, "Santa Claus Is Coming to Town."

According to David Milian, partner at Carey Rodriguez Milian LLP and lead attorney in the case, the decision represents "a milestone in the development of copyright law” because of the lengths the 2nd Circuit went to analyze the termination rights of artists under copyright law.

According to the Daily News article, Gloria Coots Baldwinand two granddaughters sued EMI Feist Catalog Inc. in Manhattan Federal Court in 2012, claiming the right to reestablish their share of publishing copyright ownership in December 2016. A three-judge appeals panel agreed, rejecting EMI Feist’s claims it could hold the copyright until 2029.
