Complex Commercial Litigation

A large part of the firm's litigation experience has centered on complex commercial fraud matters involving preliminary injunctive relief in the United States and internationally as well as the procurement of prejudgment writs of attachment and garnishment in aid of creditor's rights. In many cases, our lawyers have represented foreign financial institutions victimized by fraud in an effort to recover misappropriated assets. Most, if not all, of these cases have involved bringing actions in the United States together with parallel legal proceedings in foreign jurisdictions. In so doing, our lawyers have exercised substantial experience conducting internal corporate investigations and pre-trial asset investigations for purposes of identifying and securing assets prior to the initiation of litigation.

Our complex commercial litigation and dispute resolution practice encompasses the following types of litigation in trial and appellate courts throughout the United States:

  • Contractual disputes
  • Creditors' rights claims and lender liability
  • Commercial loan disputes, foreclosures, workouts and bankruptcy
  • Tortious interference with business relations
  • Complex commercial fraud litigation, including RICO cases
  • Insurance dispute resolution including coverage and reinsurance claims
